Simon is an Advocate, be it displaying skills of Advocacy orally in Courts, Arbitrations and Tribunals or in written legal submissions. He was awarded Silk in 2011 for his excellence in advocacy in the Higher Courts. Further, he has taught advocacy to other practitioners both in the UK and worldwide in the USA, Australia and South Africa. In particular, he has taught advocacy to practitioners worldwide conducting Commercial Arbitrations.

Simon has particular expertise in conducting Group Litigation having been Lead Counsel in the notorious Phone Hacking claims by various celebrities against News Group Newspapers (News of the World) and Mirror Group News, as well as in the Construction Industry Vetting Information Group Litigation. Simon has regularly acted in claims concerning both UK and foreign jurisdictions, has acted both for and against foreign nationals in the UK, and has represented UK parties over disputes occurring offshore concerning breach of duty and contract.

Simon has been instructed in a number of high profile cases for both well known individual and corporate Claimants and Defendants as well as drafting complex and high value legal documents – see Notable Cases.


Simon’s expertise in this field comes from not only appearing as an advocate in professional disciplinary and regulatory tribunals but also sitting as upon the Bar Disciplinary Tribunals since 1997 and since 2013 as a Chairman of the Tribunals.

This strength in the experience across the spectrum of professional regulation places Simon in an advantageous position when representing either the regulator or the professional person concerned. Further, and importantly, he is able to deal sensitively with the disciplinary issues that arise in this field.

Simon is experienced in drafting and advising upon regulations in all fields including Financial Regulation.

Instructions are welcomed both to appear on behalf of professionals who are required to face proceedings, including before any “Fitness to Practise” Committee, or to present cases on behalf of regulators.


Simon is experienced acting in a broad spectrum of insurance and insurance related claims. He breadth of knowledge is combined with specialist capability in insurance contracts, professional liability, negligence, and insurance fraud.

In relation to insurance contracts Simon has advised on disputes and has taken matters to Arbitration both for and against major insurance companies.

He is experienced in both pursuing and defending claims of professional liability. These include claims for breach of professional rules and in negligence concerning solicitors and barristers, clinical negligence claims regarding medical professionals and property claims involving surveyors.

Simon is a leading advocate in catastrophic personal injury work specialising in brain damage and spinal injury cases with niche practices both in fatal accident and in aviation accident claims.

With regard to fraud he is involved directing investigation concerning insurance fraud and pleading such fraud in litigation. Simon has worked with leading firms of solicitors, insurers and prosecuting authorities in developing strategies to combat insurance fraud. Further, he has been instructed in significant cases involving remedies for insurers following fraud cases such as obtaining freezing orders, committal for contempt of court and third party costs orders.


Simon has long been recognised as one of the most pre-eminent practitioners in this field of work. He provides “good, robust and commercial advice” (Legal 500) be it in inter parties or solicitor/client disputes.

Simon has been in the leading cases in the High Court,Court of Appeal, and the Supreme Court in multi million pound disputes as well as drafting complex legal and litigation funding documents in heavy commercial litigation.

He is at the forefront of the development of the law in the UK having been lead counsel in many landmark cases including the seminal and definitive procedural case of Mitchell v News Group Newspapers in 2014 – Court of Appeal, Frost v MGN – Supreme Court [2017], and BNM v MGN – Court of Appeal [2017].

He was on the Editorial Board of the Practitioner Textbook on this subject 2002 – 2012. He continues regularly to provide lectures and seminars on Costs Law and contributes articles to various publications including Litigation Funding.

He is an Accredited Mediator and conducts mediations in costs matters through CADR (Costs Alternative Dispute Resolution). At the invitation of the Master of the Rolls sits on the Civil Justice Council on costs matters.
